Fresnelcut converts an acoustic target into panel geometry and machine-ready cut files. Everything it reports about how a panel will perform — scattering and diffusion coefficients, absorption coefficients, usable frequency bands, design frequency, well depths — is modelled. It is computed from theory, not observed from a built panel.

Specifically, and without limiting the disclaimers in §10 and §11:

• No end-to-end validation build exists. No panel produced from this site has, to our knowledge, been cut, assembled, installed, and then measured against the figures the site predicted for it.
• The model is checked against published examples, not against measurements. Our tests compare the engine's output to worked examples and expected values from the acoustics literature. That catches arithmetic and implementation errors. It does not catch modelling assumptions that are wrong about real rooms.
• The model simplifies aggressively. It assumes idealised geometry, a rigid and non-absorbing panel surface, and plane-wave or far-field conditions depending on the calculation. It ignores construction tolerance, material losses, finish, edge effects, mounting, and the room the panel ends up in. Real panels in real rooms depart from all of that.
• Cut files are geometry, not a guarantee of fit. Kerf, tool diameter, material thickness variation, unit interpretation, and your machine's own calibration all change the finished part. The file we hand you describes intent; it is not a verified fit for your machine or your stock.
• A panel is not room treatment. A diffuser scatters reflections within its stated band. It is not room correction, it will not fix a bass problem, and one panel will not fix a room.

If and when measured validation data exists, we intend to publish it and update this section. Until this section says otherwise, assume it does not exist.

You are the engineer of record for anything you build. By using Fresnelcut you agree that, before committing material or machine time, you will at minimum:

• Cut the small calibration file first — on your machine, in your material — and confirm that real measured millimetres come out where the file says they should.
• Check the scale, units, and origin of every exported SVG or DXF in your own CAM software rather than trusting the import.
• Apply your own kerf, tool-diameter, and tolerance compensation. Fresnelcut's geometry is nominal.
• Sanity-check the design against an independent source or a second calculator if the result matters to you.
• Confirm that your material, adhesive, and finish are appropriate and safe for your machine — some sheet goods release hazardous fumes when laser cut, and some are not safe to cut at all.

Lasers, routers, saws, and CNC machines cause serious injury, fire, and permanent eye and hearing damage when misused. Fresnelcut provides drawings; it does not supervise your shop. You are solely responsible for the safe operation of your equipment, for machine guarding and fume extraction, for never leaving a running machine unattended, and for following the manufacturer's instructions and any applicable regulations.

Acoustic panels are heavy and are often hung overhead or at head height. You are solely responsible for the mounting method, the fixings, the substrate they anchor into, and the structural adequacy of the installation. Fresnelcut does not calculate mounting loads, and its hang guidance is advisory only. If you are not confident the installation is safe, have it done by someone qualified.

Nothing on this site is professional acoustic, engineering, construction, or fire-safety advice, and no consultant–client relationship is created by using it.

You must be at least 18 — or old enough to form a binding contract where you live, with a parent or guardian's consent — and legally permitted to use the service. If you create an account you agree to give accurate information, keep your credentials confidential, and be responsible for everything done under your account. Tell us promptly at phil@denoncourtassociates.com if you believe your account has been compromised.

We may suspend or terminate an account that breaches these terms, that is being used to abuse the service, or where we are required to do so. You may close your account at any time.

You keep ownership of the designs you create and the cut files you export. We claim no rights in the panels you build or in anything you make or sell with them — commercial use of your exports is fine and needs no attribution.

You grant us only the limited licence we need to run the service: storing your saved designs, rendering previews, and generating exports. If you choose to make a design public — for example by sharing it to the gallery — you additionally grant us a non-exclusive, worldwide, royalty-free licence to host, display, and link to that design for as long as it stays public. You can make it private again at any time. Only publish designs you have the right to publish.

The site itself — its software, engine, text, and branding — remains ours, and is not licensed to you beyond ordinary use of the service.

You agree not to:

• Present Fresnelcut's modelled figures as measured performance data, as certified data, or as a test report — to customers, clients, or anyone else.
• Resell or redistribute the service itself, or scrape, spider, or bulk-extract from it.
• Interfere with the service, probe or breach its security, or circumvent access controls, rate limits, or paywalls.
• Upload or publish content that infringes someone else's rights, or that is unlawful, misleading, or malicious.
• Use the service to build anything intended to cause harm.

Core design and export features are currently free. Where the site offers paid credits or a subscription, prices are shown at checkout and payment is handled by our payment processor — we never receive or store your full card details. Credits are a limited licence to use the service, not currency: they have no cash value, are not transferable, and are not redeemable for cash.

Given the validation status described in §1, we would rather refund you than have you feel misled. If you paid for something and it did not do what you reasonably expected, email phil@denoncourtassociates.com and we will refund it. Subscriptions, where offered, renew until cancelled and can be cancelled at any time, effective at the end of the current period. Any statutory refund or cancellation rights you have are unaffected by anything in these terms.

Fresnelcut is offered on an as-available basis and is under active development. Features can change, move, or be withdrawn. The acoustic engine can be revised, which means a design re-opened later may compute differently than it did when you saved it. We do not guarantee uptime, and we do not guarantee that saved designs will be retained indefinitely. Export and keep your own copy of anything you care about — the exported file is yours and does not depend on us continuing to exist.

The site relies on third-party services to operate — hosting, a payment processor, email delivery, and analytics — and their handling of data is governed by their own terms. We use analytics to understand aggregate usage. Design computation runs in your browser: your in-progress design is not uploaded unless you choose to save or share it.

To the fullest extent permitted by law, Fresnelcut is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We specifically make no warranty that the acoustic model is accurate, that predicted performance will be achieved in practice, that generated geometry is correct or manufacturable, that exported files will import correctly into your software or cut correctly on your machine, or that a panel built from this site will improve — or will not worsen — the sound of your room. As set out in §1, none of that has been verified by measurement.

To the fullest extent permitted by law, Denoncourt Digital Assets and anyone involved in producing Fresnelcut will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profit, revenue, data, goodwill, materials, machine time, or cost of substitute goods, arising out of or relating to your use of the service or anything you build from it — even if we were told such damages were possible.

Our total aggregate liability for all claims relating to the service is limited to the greater of the amount you actually paid us in the twelve months before the claim arose, or USD 50.

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law — including liability for death or personal injury caused by negligence, or for fraud — and if you are a consumer, your statutory rights are unaffected.

You agree to indemnify and hold harmless Denoncourt Digital Assets from third-party claims arising out of your use of the service, anything you build, install, or sell using it, your breach of these terms, or your infringement of someone else's rights.

We may update these terms as the service develops — in particular, §1 will change if and when measured validation data exists. The “last updated” date at the top shows the current version. Continuing to use the service after a change means you accept the updated terms; if you do not, please stop using the service.

These terms are the entire agreement between you and Denoncourt Digital Assets regarding the service. If any provision is found unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a transfer of the service.
